Competition rules “buy this product and get a refund up to 100% of the purchase value” (Competition for the most helpful review of a product purchased at TanExpert24)

§ 1 General provisions

  1. The organizer of the competition named ,,buy this product and get a refund up to 100% of the purchase value” (hereinafter: Competition) is TanExpert, VT7 Sp. z o.o., based in Szczecin (70-535) at Kurkowa 5/U2, registered in the National Court Register by the District Court in Szczecin, XIII Economic Department of the National Court Register, under the number KRS 0001009773, REGON: 366502117, NIP: 8522628345 (hereinafter: Organizer).

  2. The Competition is organized under the terms set out in these regulations (hereinafter: Regulations).

  3. The competition is conducted in the territory of the Republic of Poland via the website tanexpert24.pl (nationwide competition).

  4. The competition is available to customers of the online store: tanexpert24.pl under the terms described in the Regulations.

  5. The competition will reward the most interesting reviews (containing helpful and truthful information) about products purchased by the Competition Participant in the online store www.tanexpert24.pl.

  6. The competition starts on 01.07.2021 and lasts until 30.06.2024.

§ 2 Participation in the Competition

  1. Participation in the competition may be taken by an adult individual, with full legal capacity and residing in Poland, who makes a purchase for non-business or professional purposes, i.e., as a consumer under Article 221 of the Civil Code and meets other conditions specified in the Competition Regulations, including submitting a review of the purchased product (excluding product groups specified in Appendix 1 to these Regulations).

  2. Employees of the Organizer and members of their immediate families cannot participate in the competition. Immediate family members are: spouses, children, parents, siblings. An employee, under these Regulations, refers to both persons employed under an employment contract and persons working under a civil law agreement.

  3. To ensure proper organization and course of the competition, especially for assessing the validity of submissions and selecting the winners, the Organizer has appointed a competition committee (hereinafter: Competition Committee). The Competition Committee consists of three individuals designated by the Organizer, namely:

    1. a) General Director,

    2. b) Marketing Manager,

    3. c) Customer Service Specialist.

§ 3 Course and conditions of participation in the Competition

1. The condition for participating in the competition is fulfilling the following conditions: a) making a purchase of a product at the online store www.tanexpert24.pl excluding product groups specified in Appendix 1 to these Regulations,

  1. b) having proof of purchase (i.e., a consumer invoice, which does not contain the NIP number) confirming the above-mentioned purchase and payment for it,

  2. c) consenting to receive marketing communications to the email address and phone number provided in the registration form, to which the Organizer will send information related to current promotional offers from TanExpert stores.

  3. d) providing a review on the Organizer’s account in the Ceneo service, regarding the purchase of the product corresponding to the proof of purchase,

  4. Each transaction is treated as a separate entry.

  5. The Participant's review about the purchased product must include their personal beliefs and must be written in Polish, following the rules of proper Polish language.

  6. Reviews that do not comply with the regulations of Ceneo.pl sp. z o.o. will not be considered in the competition.

§4 Prizes and the procedure for selecting winners

  1. Each month during the competition, 3 winners will be chosen, and they will receive equal prizes as described in paragraph 2. The Competition Committee will select the winners from among the authors of the reviews who have met all the requirements from the previous calendar month. The prizes will be awarded to those participants whose reviews are considered by the Competition Committee as the most useful, interesting, and relevant to the competition theme. The selection of the winner will depend on the substantive, unique, and creative character of the review – among the submitted reviews, the Committee will choose those that it considers the most useful for other users of the website www.tanexpert24.pl when selecting a product and making a purchasing decision.

  2. The prize is a discount code worth 100% of the purchase value to be used in the online store www.tanexpert24.pl. The discount code can be redeemed from the "Cart" page. The code also includes free shipping. The coupon can be used only once.

  3. The coupon is valid for 90 days from the date of creation, and this period cannot be extended. After the validity period, the coupon becomes invalid, and any remaining funds on the card are forfeited to the Organizer. When purchasing products using the coupon, no additional discounts or promotions apply. The use of the coupon cannot be combined with any other price or installment promotion.

  4. Each prize in the competition is associated with an additional monetary reward calculated according to the formula [Value of prize * 10/9 – Value of prize] and rounded to the nearest whole zloty. The additional monetary reward will not be awarded to the winner but will be withheld by the Organizer to cover the income tax due on the prize at a rate of 10% of the prize value according to Article 41(4) and Article 30(1)(2) of the Personal Income Tax Act.

  5. Meetings of the Competition Committee will take place at the Organizer's headquarters within 7 business days from the end of each calendar month.

  6. The winners of the competition will be notified of their win by the 15th of the month following the month for which the prizes are awarded, via email sent to the email address provided during the participant's order.

  7. The prize is not exchangeable for cash.

  8. In case of withdrawal from the purchase agreement under which the Participant participated in the competition, the participant is not entitled to receive the prize and has no claim against the Organizer.

The participant must provide accurate data in the purchase form. If the data changes, the participant must inform the Organizer. Failure to comply with this obligation may prevent the Organizer from issuing the prize.

§ 5 Copyrights

  1. The participant grants the Organizer an unlimited, time-based license to use, distribute, publish, copy, modify, and distribute all reviews submitted by them.

  2. Under the granted license, the Organizer has the right to:

  3. distribute reviews by publicly making them available in such a way that everyone can access them at any time and place (Internet), publicly displaying and republishing,

  4. store and duplicate reviews—producing copies by any technique, including printing, reprographic, magnetic recording, and digital techniques.

As part of the granted license, the author agrees to the use of the review in any parts, granting sublicenses to third parties to use the work or any of its parts, and using the work or any part for promotional and advertising purposes by the Organizer. At the same time, the author, by granting the license, ensures the Organizer that the review is their original work and is the result of their intellectual effort, without infringing third-party copyrights.

In case of untruthfulness of the above statements, the participant is responsible for violating third-party rights.

§ 6 Complaints

  1. Complaints regarding the course of the competition can be submitted by email to biuro@tanexpert.pl or in writing to: TanExpert Polska, Kurkowa 5/U2, 70-535 Szczecin, no later than 15.01.2022 (date of receipt by the Organizer applies).

  2. The right to submit a complaint in the competition belongs only to the participants of the competition.

  3. Complaints will be reviewed by the Committee within 14 (fourteen) days from the date of receipt.

  4. The participant will be notified of the complaint's resolution by email

sent to the email address from which the complaint was submitted or to the correspondence address from which the complaint was submitted.

§ 7 Personal Data Protection

  1. Personal data of competition participants are processed based on the provisions of the applicable personal data protection law, including Regulation (EU) 2016/679 of the European Parliament and Council of April 27, 2016, regarding the protection of individuals in relation to the processing of personal data and the free movement of such data, and repealing Directive 95/46/EC.

  2. The administrator of personal data is the Organizer. The data will be processed for the purpose of running the competition. The data will also be processed for marketing purposes according to the applicable Regulations and Privacy Policy.

§ 8 Final Provisions

  1. These regulations come into effect on 20.08.2021.

  2. In case of any violation of the provisions of the Regulations by a Participant, the Organizer is entitled to exclude them from the competition. The Organizer may exclude from the competition participants who, in particular:

    1. engage in illegal activities, especially if their behavior harms the interests of third parties;

    2. engage in activities aimed at circumventing the Regulations or the security or operational rules of the competition, after an explanatory investigation confirming the above-mentioned suspicion.

  3. In matters not regulated by the Regulations, the provisions of the Civil Code and other laws apply.

  4. The participant is obliged to read the content of these regulations, and participation in the competition means acceptance of these regulations.

  5. The Organizer reserves the right to change the Regulations and the terms of the competition during its course, only if it is justified by the competition's purpose and does not worsen the participation conditions, provided that such changes do not infringe the rights already acquired by participants. All participants will be notified of the change of the Regulations via email to the addresses provided in the registration form.

  6. All disputes between the organizer and the participant will be resolved by the competent common court.

  7. The competition is not a gambling game within the meaning of the Act of November 19, 2009, on Gambling (consolidated text: Journal of Laws 2020, item 2094, as amended).
