Terms and conditions of the "TanExpert Ambassador" Campaign

§ 1. GENERAL PROVISIONS

  1. The company VT7 Sp. z o.o. based in Szczecin (ul. Kurkowa 5/u2, 70-535 Szczecin, NIP: 8522628345) is the organizer of the campaign called "TanExpert Ambassador" (hereinafter referred to as the "Collaboration").
  2. This regulation defines the terms and conditions of the Collaboration.
  3. The Organizer clarifies that the Collaboration is not a form of gambling, a promotional lottery, or a mutual bet according to the Act of November 19, 2009, on Gambling (consolidated text: Journal of Laws of 2019, item 847, as amended).
  4. The Collaboration is carried out within the territory of the Republic of Poland.
  5. The duration of the Collaboration is 30 calendar days and is counted from the day the products are received.
  6. The Organizer has the right to extend the duration of the Collaboration.
  7. Participation in the Collaboration requires familiarization with the Regulation and acceptance of its provisions.

§ 2. RULES AND COURSE OF COLLABORATION

  1. The Collaboration is carried out on the Ambassador's social media platforms, and its course is supervised by the Organizer.
  2. The Ambassadors have the opportunity to share information about the Collaboration on the Organizer's channels, such as Instagram (https://www.instagram.com/tanexpert/) and Facebook (https://www.facebook.com/tanexpertPL/). The Collaboration’s regulations will be published on the website (https://tanexpert24.pl/pl/), administered by the Organizer.
  3. The person eligible to participate in the Collaboration is an individual (referred to as the "Ambassador") who meets the following conditions:
    • is of legal age, with full legal capacity,
    • has an active, public account on Instagram or Facebook - the account must belong to the participant in the Collaboration,
    • shows interest in cosmetics, particularly tanning products, and actively engages on social media (such as Instagram, Facebook, TikTok, YouTube) as an influencer,
    • has a large following of at least 5,000 followers,
    • expresses their intention to participate in the Collaboration by sending a private message. The participant must read and accept these regulations.
  4. Participation in the Collaboration is voluntary and free of charge, and the participant commits to familiarizing themselves with the Regulations before joining. Compliance with the conditions specified in § 2 point 2 of the Regulations is a prerequisite for participation.
  5. Employees or collaborators of the Organizer cannot participate in the Collaboration. Each Ambassador is entitled to submit only one application for the Collaboration.

§ 3. PRODUCTS IN THE COLLABORATION

  1. As part of the Collaboration, the Organizer will provide the Ambassadors with cosmetics to promote. After receiving the products, the Ambassador has 14 calendar days to complete the following tasks:
    • The Ambassador, within 30 calendar days of receiving the cosmetics from the Organizer, is tasked with promoting the received products from TanExpert (https://tanexpert24.pl/pl/) on their Instagram or Facebook account, in accordance with the instructions provided by the Organizer,
    • The Ambassador is tasked with
      • Within 14 calendar days from receiving the package: recording a story (Instagram/Facebook stories) on their social media account showcasing the unboxing of the products received from TanExpert (https://tanexpert24.pl/pl/), a full review of the cosmetics, and the application of self-tanners, in accordance with the Organizer's guidelines,
      • Within 14 calendar days from receiving the package: creating a post on their social media account showcasing the products received from TanExpert (https://tanexpert24.pl/pl/), in accordance with the Organizer's guidelines,
    • The Ambassador agrees to review the received cosmetics according to the Organizer's guidelines.
    • Each TanExpert Ambassador will receive at least one package of cosmetics with products worth at least 650 PLN. The packages will be sent based on email correspondence between the Organizer and the Ambassadors. Additionally, Ambassadors will receive a discount code for their followers on Instagram or Facebook.
    • The Organizer will verify each application to ensure the conditions outlined in § 2 point 2 of the Regulations are met.
    • The Organizer will respond to the submitted application within 10 business days from its receipt.
    • The Organizer is responsible for the proper preparation and delivery of the promotional products.
  2. TanExpert Ambassadors must confirm their ability to receive the products and provide the necessary shipping details within 7 days of being informed of their Ambassador status. The cosmetics will be sent via courier to the Ambassador's address in Poland.
  3. If a participant violates the provisions of the Regulations, the Organizer has the right to exclude them from the Collaboration. A person who has been excluded may not reapply for participation. The decision to accept or exclude an application is solely at the discretion of the Organizer.
  4. The Organizer is not responsible for the content and form of materials published by Participants in connection with the Collaboration.
  5. A procedure to receive the products requires each Participant to sign an agreement with the Organizer, which includes the use of the Ambassador's image in advertising and promotional campaigns for a period of 12 months and the submission of a signed statement by the Ambassador, the template of which is attached as Appendix 1 to the Regulations.

§ 4. COMPLAINTS

  1. Complaints related to the Collaboration should be submitted via email to wspolpraca@tanexpert.pl or by post to the address specified in § 1 point 1 of the Regulations.
  2. The Organizer will review complaints promptly and within 14 days from the date of receipt of the complaint.

§ 5. PERSONAL DATA PROTECTION

  1. The Organizer processes personal data of Participants, such as: first and last name or profile name on Instagram, address, phone number, and email address. The Ambassador of this Collaboration is required to provide their email address and other personal details necessary for the delivery or realization of the products. The Organizer has the right to select another Ambassador from the Participants if the Ambassador does not provide their details within 7 days of the Collaboration announcement.
  2. The personal data of Participants in the Collaboration will be processed in accordance with applicable law, especially with the European Parliament and Council Regulation (EU) 2016/679 of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, repealing Directive 95/46/EC (General Data Protection Regulation) (Official Journal of the EU L 119, p. 1), which came into effect on May 25, 2018, hereinafter referred to as "GDPR".
  3. The Organizer is the data controller of the Participants' personal data processed in connection with the Collaboration.
  4. The personal data of Participants in the Collaboration will be processed to ensure the proper course of the Collaboration, including the delivery of products for publication on the Ambassadors' social media profiles.
  5. The personal data of Participants may be shared by the Administrator with entities processing them on its behalf, particularly IT service providers, including those responsible for managing the Shop's website, but only for the purposes and to the extent necessary to achieve the aforementioned goal. The Participant has the right to access their personal data, correct it, delete it, restrict processing, and the right to data portability, as ensured by the Administrator.
  6. The possibility of participating in the Collaboration is contingent on the Participant voluntarily providing their personal data. If the Participant does not provide the required personal data or provides false or incomplete data, their participation in the Collaboration will be denied.

§ 6. FINAL PROVISIONS

  1. This Regulation does not exclude the mandatory provisions of Polish law.
  2. The Organizer has the right to make changes to the Regulation at any time, but this will not affect the rights of Participants who have already submitted their applications. In case of changes, the Organizer will notify Participants on the website where the Regulation will be published.

The Regulation comes into effect on 10.05.2023.
