Terms and conditions of the "TanExpert Ambassador" Campaign

§ 1. GENERAL PROVISIONS

  1. VT7 Sp. z o.o. based in Szczecin ( ul. Kurkowa 5/u2, 70-535 Szczecin, NIP: 8522628345) is the organizer of the action entitled " TanExpert Ambassador" (hereinafter referred to as the "Cooperation").
  2. These Terms and Conditions define the conditions of the Cooperation.
  3. The Organizer clarifies that the Cooperation is not a form of gambling, promotional drawing or betting in accordance with the Act of November 19, 2009 on gambling games (consolidated text: Journal of Laws of 2019, item 847, as amended).
  4. The cooperation shall be implemented on the territory of the Republic of Poland.
  5. The duration of the Cooperation is 30 calendar days and is calculated from the date of receipt of the products.
  6. The Organizer has the right to extend the duration of the Cooperation.
  7. Participation in the Cooperation involves reading and accepting the Terms and Conditions.

§ 2. RULES AND COURSE OF COOPERATION

  1. The Collaboration is carried out on the Ambassadors' social networks, and its course is supervised by the Organizer. The Ambassadors can share information about the Cooperation on the Organizer's channels, such as Instagram (https://www.instagram.com/tanexpert/) and Facebook (https://www.facebook.com/tanexpertPL/). The Regulations of the Collaboration will be published on the website (https://tanexpert24.pl/pl/), whose administrator is the Organizer.
  2. A person eligible to participate in the Collaboration is an individual (referred to as an "Ambassador") who meets the following conditions:
    • is a person of full legal age with unlimited legal capacity,
    • has an active, public account on the Instagram or Facebook social network - this account must be owned by the participant of the Cooperation,
    • demonstrates an interest in cosmetics, especially tanning cosmetics, and is active on social networks (such as Instagram, Facebook, TikTok, YouTube) as a so-called Influencer. The person should have a large following of no less than 5,000 followers,
    • will apply for participation in the Cooperation by sending a private message,
    • A person interested in participating in the Collaboration must read and accept these Terms and Conditions.
  3. Participation in the Cooperation is voluntary and free of charge, and the participating person agrees to review the Terms and Conditions before joining the Cooperation. A prerequisite for participation in the Cooperation is the fulfillment of the conditions specified in § 2 item 2 of the Terms and Conditions.
  4. Persons employed or cooperating with the Organizer may not participate in the Cooperation.
  5. Each Ambassador is entitled to submit only one application to the Collaboration.

§ 3. PRODUCTS WITHIN THE COOPERATION

  1. As part of the Collaboration, the Organizer will provide the Ambassadors with promotional cosmetics. After receiving the products, the Ambassador has 14 calendar days to complete the following tasks:
    • The Ambassador, after receiving the cosmetics from the Organizer within 30 calendar days, is to promote the received products from the TanExpert store (https://tanexpert24.pl/pl/) on her account on the Instagram or Facebook social network, according to the guidelines set by the Organizer,
    • The ambassador is to
      • Within 14 calendar days of receiving the package: to record testimonials (instastory/stories) on her Instagram/Facebook social network user account involving unboxings of the packages with products received from the TanExpert Store (https://tanexpert24.pl/pl/), full review of the cosmetics and self-tanners application, according to the guidelines set by the Organizer,
      • Within 30 calendar days of receiving the package: create a post on her Instagram/Facebook social network user account involving the products received from the TanExpert Store (https://tanexpert24.pl/pl/), according to the guidelines of the Organizer,
        • The Ambassador agrees to review the cosmetics received in accordance with the Organizer's guidelines.
  2. Each TanExpert Ambassador will receive as part of the Cooperation:
    • at least one package with cosmetics, which will contain products offered in the Store with a value of at least 300 PLN. The packages will be delivered on the basis of e-mail correspondence between the Organizer and the Ambassadors.
    • In addition, the Ambassadors will be given the opportunity to receive a discount code for those who follow their account on Instagram or Facebook social networks.
  3. The Cooperation Organizer will check each application to ensure that the conditions listed in § 2 pt. 2 of the Regulations are met.
  4. The Organizer will respond to the submitted application within 10 working days of receiving it.
  5. The Organizer is responsible for proper preparation and delivery of the promotional products.
  6. The TanExpert Ambassadors must confirm the ability to receive the products and provide the necessary shipping details within 7 days from the date of receiving information about becoming an Ambassador. Cosmetics will be sent via courier service to the address in Poland indicated by Ambassadors.
  7. If the Participant violates the Terms and Conditions, the Organizer has the right to exclude him/her from participation in the Cooperation. A person who has been excluded cannot apply again. The decision to apply or exclude is decided solely by the Organizer.
  8. The Organizer is not responsible for the content and form of materials published by Participants in the Cooperation.
  9. The procedure required to receive cosmetics requires each Participant to sign an appropriate agreement with the Organizer, which will include, among other things, the use of the Ambassador's image in advertising and promotional campaigns for a period of 12 months, and to provide the Organizer with a statement signed by the Ambassador, a sample of which is attached as Appendix 1 to the Terms and Conditions.

§ 4. COMPLAINTS

  1. Submitting complaints regarding the conduct of the Cooperation shall be done via e-mail address wspolpraca@tanexpert.pl or by mail to the address indicated in § 1 item 1 of the Terms and Conditions.
  2. The Organizer will process complaints immediately and no later than within 14 days from the date of receiving the complaint.

§ 5. PERSONAL DATA PROTECTION

  1. The Organizer shall process Participants' personal data, such as: name and surname or profile name on Instagram, address, telephone number and e-mail address.
  2. The Ambassador of this Cooperation is obliged to provide the Organizer with her e-mail address and other personal data necessary for the delivery or realization of the products. The Organizer has the right to conduct the selection of another Ambassador from among the Participants if the Ambassador has not provided her data within 7 days from the date of announcing the Cooperation.
  3. The personal data of the Participants of the Cooperation will be processed in accordance with the applicable laws, in particular with the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27.04.2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and the repeal of Directive 95/46/EC (General Data Protection Regulation) (Official Journal of the EU L 119, p. 1), which entered into force on 25.05.2018, hereinafter referred to as "GDPR".
  4. The Organizer is the administrator of the Participants' personal data processed within the Cooperation.
  5. The personal data of the Participants of the Cooperation will be processed in order to ensure the proper conduct of the Cooperation, including the delivery of the cosmetics intended to be published on the Ambassador's social profiles.
  6. The personal data of the Participants of the Cooperation may be provided by the Administrator to entities processing them on his/her behalf, in particular to entities providing IT services, including those responsible for the management of the Store's website, but only for the purpose and to the extent necessary to achieve the aforementioned purpose.
  7. The participant has the right to request access to his/her personal data, their correction, deletion, restriction of processing and the right to data portability is provided by the Administrator.
  8. The possibility of participation in the Cooperation is subject to the Participant voluntarily providing her personal data. If the Participant does not provide the required personal data or provides false or incomplete data, it will prevent his participation in the Cooperation.

§ 6. FINAL PROVISIONS

  1. The Terms and Conditions do not exclude the mandatory provisions of Polish law.
  2. The Organizer has the right to make changes to the Terms and Conditions at any time, but this will not affect the rights of Participants who have already sent the application. In case of changes, the Organizer will notify the Participants on the website where the Terms and Conditions will be published.
  3. The Terms and Conditions shall come into force on 10.05.2023.
